   Dat is wel een beetje balen. Ging net zo goed met de koers. Verwacht toch dat BAYER de komende tijd gaat herstellen in koers met af en toe wat terug.
   
   

   Komt nooit meer goed met dat RoundUp. Is echt een nachtmerriedossier. Bayer had nooit voor een gedeeltelijke schikking moeten gaan. Dat zette de deur juist open voor een pittig proces met alle overige eisers. Was een domme zet, mijns inziens.

Tot dusver zijn er slechts drie zaken behandeld voor rechtbanken, die alle drie verloren zijn gegaan door de Dax (DAX 30) -groep. Bayer heeft ook geen succes gehad bij benoemingsprocedures

   Laten we het hopen, weekend van bezinning en maandag week rustig beginnen. Groen zal het wel niet worden maandag, maar hopelijk in Europa iets minder paniek en een wat beperktere schade.

    May 14 (Reuters) - A federal appeals court on Friday upheld a $25 million judgment and trial verdict finding Bayer's Roundup caused a California resident's non-Hodgkin lymphoma, dealing a blow to the chemical company's hopes of limiting its legal risk over the weed-killer.
    
    The 9th U.S. Circuit Court of Appeals in San Francisco rejected Bayer's argument that lawsuits like Edwin Hardeman's never should go to trial because federal pesticide laws barred allegations that the company failed to warn of Roundup's cancer risks.
    
    "It's a slam dunk for plaintiffs," said Leslie Brueckner, an attorney with Public Justice who helped with Hardeman's appeal. "This proves these claims are viable in the tort system."
    
    Bayer did not immediately respond to a request for comment.
    
    A jury in 2019 awarded Hardeman $5 million in compensatory damages and $75 million in punitive damages in the first federal case to have gone to trial. The punitive award was later cut to $20 million and the appeals court also upheld the reduction.
    
    Friday's ruling was the first by a federal appeals court in a case linking Roundup and cancer and Bayer had said the case had the potential to "shape how every subsequent Roundup case is litigated."
    
    Bayer has said that decades of studies have shown Roundup and other glyphosate-based herbicides that dominate the market are safe for human use.
    
    The company has argued that glyphosate was approved by the Environmental Protection Agency as safe for humans and that regulators prevented it from adding a warning to the product's label.
    
    But the company has spent years trying to contain the litigation.
    
    Bayer has committed $9.6 billion to settle 125,000 claims over Roundup. On Wednesday it will seek preliminary approval for a $2 billion proposed deal to resolve future claims by the millions of consumers and farmworkers who have been exposed to Roundup but have not gotten sick.
    
    "The timing couldn't be more perfect," said Brueckner, referring to Wednesday's hearing. "I doubt it was accidental."
    
    Proponents of the agreement to create a framework for resolving future cases had argued that consumers would benefit from the deal because they might lose the right to sue Bayer if a federal appeals court sided with company.
    
    "This decision wipes that argument off the table," said Brueckner.
    
    Consumer advocates and personal injury attorneys have objected to the $2 billion agreement on future cases because they argue it wrongly limits rights to sue.
    
    The agreement proposed giving those exposed to Roundup free medical exams and, if they develop non-Hodgkin lymphoma, compensation worth up to $200,000 as well as free legal advice.
    
    The agreement would pause all litigation for four years and prevent consumers from seeking punitive damages. But anyone rejecting the compensation would still retain the right to sue for compensation once the litigation pause expired.     Ik denk persoonlijk niet. Alles moet nog tot het hooggerechtshof worden afgehandeld. Ik verwacht maandag niet een grote min.
    Gaat uiteindelijk gewoon verder omhoog.....

    gaat vast meer kosten, maar geen 25 mln per persoon. Waarschijnlijk zal de vergoeding omhoog moeten. Advocaten weten ook wel dat zaken jaren duren. Zou jammer zijn als cliënten de eindstreep niet weten te bereiken.
    
    Ofschoon ben ik van mening , dat round-up een prima middel is, mits je het op de juiste wijze toepast.

    Ik geloof er niks van. Dit staat een finale afwikkeling van 2 miljard juist in de weg en zorgt ervoor dat de hoofdpijn in een stevige migraine verandert. Terug tot onder de 50 zie ik eerder gebeuren op korte termijn.

    Dit kon niet beroerder qua timing… spannende week voor de boeg. Vrees dat we nog wel iets wegzakken. Maar goed veel van de pijn is ingeprijsd en de huidige winsten komen door relatieve goede marktomstandigheden, niet door voortgang op roundup. Dit test mijn geduld wel weer enorm.. maar goed we gaan maandag zien hoe en wat, en dan woensdag kijken hoe verder.

    Gezien het bericht hierboven van Reuters, iemand nog enig idee hoe die settlement komende woensdag er door heen kan komen?
    
    Denk het niet en vrees dat dit een opmaat is voor geen deal en jarenlang verder procederen. Vrees dat de koers verder terug gaat vallen en we de komende maanden door gaan modderen. Ben geneigd om Maandag morgen uit te stappen voor een tijdje.

    Bayer AG lost its second appeal of the three jury verdicts finding that the company’s Roundup weed killer causes cancer.
    
    The U.S. Court of Appeals in San Francisco refused on Friday to overturn the 2019 decision in the only case to go to trial in federal court. The decision may embolden consumers to bring more claims beyond the many thousands the company is trying to resolve in an $11 billion settlement.
    
    Bayer, which was testing an argument that it hoped would undercut thousands of outstanding cases, said it’s disappointed with the ruling and may appeal to the U.S. Supreme Court.
    
    The company contended the U.S. Environmental Protection Agency’s authority to regulate herbicide labeling prohibits states from imposing demands that depart from federal requirements. The company said the verdict was improperly based on a California law requiring Bayer to warn consumers of Roundup’s cancer risk. The EPA supported Bayer’s appeal
    
    The plaintiff in the case, Edwin Hardeman, testified that he used Roundup for years on his large plot of land in Sonoma County, about 60 miles (100 kilometers) north of San Francisco. Similar to other plaintiffs in the U.S., Hardeman said his exposure caused his non-Hodgkin’s lymphoma. Jurors awarded him more than $80 million, later cut by the trial judge to $25 million.
    
    The appeals court panel affirmed the $25 million award, though one of the three judges dissented, saying the $20 million punitive damages portion of the award is too high according to constitutional guidelines.
    
    The company’s “conduct is not particularly reprehensible in light of the ongoing scientific debate,” U.S. Circuit Judge N.R. Smith wrote.
    
    Hardeman’s suit was the second of three Roundup trials Bayer lost in 2018 and 2019 with average awards of almost $50 million per plaintiff that sent its stock into a downward spiral. The other two cases were tried in California state court. The company lost its appeal of the first verdict -- though it did win a reduction in damages -- and is appealing the third verdict.
    
    The legal threat has weighed on Bayer since its 2018 acquisition of Monsanto, maker of the herbicide. Despite an $11 billion proposal to resolve the U.S. suits announced in June, the Roundup litigation has proved more expensive and difficult to contain than Bayer calculated. In November, the judge who handled Hardeman’s trial and has been overseeing about 4,000 federal cases resumed readying cases for trial after a pause to allow for lagging settlement negotiations.
    
    Bayer said Friday it continues to stand by the safety of Roundup based on decades of testing by regulators.
    
    “The 9th Circuit decision is wrong on the issue of federal preemption as it is not possible for Monsanto to comply with federal law under which EPA has determined that a cancer warning is unwarranted and improper, and also comply with state law failure-to-warn claims seeking the very cancer warning EPA forbids,” the company said in a statement. “The company will pursue all legal options, including petitioning the U.S. Supreme Court to review this case.”
    
    Lawyers for Hardeman said he’s pleased with the ruling.
    
    The court ruled that “substantial evidence of Monsanto’s malice was presented to the jury, supporting punitive damages,” Aimee Wagstaff and Jennifer Moore said in an email. “Internal emails showed that Monsanto knew of the risk of cancer and failed to warn consumers like Mr. Hardeman. Today is significant for consumers holding pesticide companies like Monsanto accountable for causing thousands of people cancer.”

    Er ligt derhalve een zuivere rechtsvraag voor:

    De federale EPA staat derhalve achter Bayer, i.e. zij vinden dat Bayer goed gehandeld heeft, i.e. kankerrisico hoeft niet opgelezen te worden. Volgens Californische wetgeving moest dit wel en dat volgt de Californische rechter nu, waarbij aangetekend dat een rechter zegt:

    M.a.w. er zijn in juridische zin toch wel wat openingen om naar het US Supreme Court te gaan en daar te winnen. Dat weten de advocaten van slachtoffers natuurlijk ook, zij zullen trachten de settlement betalingen op te voeren. Dit kan dus ook een opstapje zijn naar een finale, doch duurdere settlement.
    
    Uiteindelijk is een settlement ook gunstig voor de advocaten want dan worden hun rekeningen betaald.
