    Arcelormittal Patent case against AK Steel revived on Appeal

    Bloomberg Law reported that in a sealed opinion, the US Court of Appeals for the Federal Circuit vacated and remanded a case in which ArcelorMittal had sought to revive a patent infringement suit against AK Steel. The dispute, which dates back to 2013, is over high-strength steel used by automobile manufacturers.

    The trial court had ruled there was no infringement by West Chester, Ohio-based AK Steel Corp. Luxembourg-based Arcelor Mittal appealed.

    Trump Trade War - Tariff exemption process remains frustrating

    Presentation slides included in documents released to Marketplace under a Freedom of Information Act request offer a window into the Trump administration’s process for evaluating applications by companies seeking waivers from steel and aluminum tariffs. Companies interviewed by Marketplace over the past few months have expressed frustration at that process. The presentation slides were part of a training program for employees involved in the Section 232 exemption process. The presentation included slides with titles such as "What Is a Section 232 Investigation?" and "Exactly What Is Meant by Steel Mill Products?"

    Mr Ronnie Smith, vice president of operations at McMahon Steel Co. in Houston, has been on the receiving end of the evaluation process shown in the presentation slides. He submitted over a dozen exclusion requests to the Department of Commerce in June because he says certain products that McMahon buys are unavailable domestically. Some of his request were initially denied by the Department of Commerce.

    Based on the presentation slides, Mr Smith said he’s not convinced the people evaluating his requests were prepared to do so. He said that “I'm a guy who's been [in the steel business] for over 30 years, and, you know, I still don't know everything obviously about metallurgy, the metals markets, harmonized tariff codes and things like that … it's hard to envision that somebody would be able to gain enough knowledge from a PowerPoint presentation to make these kind of determinations.”

    A Department of Commerce spokesperson told Marketplace that the average time taken to review one of these requests varies, but likely takes three to four months or longer if an objection is filed. Smith has refiled his original requests, but he’s loosing business while they’re pending in the Department of Commerce.

    Big River Steel acquisition off the table, JV possible - Report

    SP Global reported that Big River Steel is no longer entertaining acquisition offers, though the company is open to exploring joint-venture opportunities, a spokeswoman for the company confirmed. Speculation around Big River's potential acquisition picked up this summer as a number of US competitors and foreign mills were said to be showing interest in the privately held company. Industry analysts expected that the company's valuation could top USD 2 billion, marking the most significant deal in the US steel industry in the last five years.

    Spokeswoman Patty Rioux said that "Big River Steel's owners came together to build a growth platform in the steel industry through greenfield projects and bold acquisitions and that is what we intend to do. While the valuations surrounding our company were flattering, we see a very bright future for our employees, suppliers and customers as we grow and expand our company."

    Big River, which began operating its sheet mill in Osceola, Arkansas, in 2017, is open to bringing in a joint venture partner with expertise in making automotive-grade, advanced high-strength steels and electrical steels, the spokesperson said. In its first year of operation, Big River produced 1.3 million st of steel.

    In June, Big River announced it was moving ahead with plans to spend $1.2 billion to double the Osceola mill's capacity to 3.3 million st by late 2020. In April the company signed an option agreement 800 acres of land in Brownsville, Texas, which could be the site of a second steel mill.

    BHP iron ore stockpiled at West Australian port

    AAP reported that BHP doesn't have enough iron ore stockpiled at a West Australian port to cover its scheduled shipments after a fully laden runaway train was deliberately derailed, causing rail operations to be suspended. The BHP-operated train took off early on Monday after the driver stepped out to inspect one of its 268 wagons. The nearly 3km-long locomotive hurtled along the company's Newman to Port Hedland line for about 50 minutes until it was deliberately derailed by remote control at a centre more than 1500km away in Perth.

    Nobody was injured. "We cannot speculate on the outcome of the investigation however we are working with the appropriate authorities and our focus remains on the safe recovery of our operations," the company said in a statement. About 1.5km of track repairs will take about one week to partially complete and BHP says it will liaise with customers about its contractual commitments given the stockpile will not cover the entire period of disruption.

    According to Reuters, one of BHP's customers in China, a steel producer, has not yet received any notice from the miner.

    An official, who declined to be named, told the newswire "We have a long-term contract with BHP and we haven't received a notification so far."

    Workers to end strike at Shougang iron ore mine in Peru - Union

    Reuters reported that workers at Chinese company Shougang Group’s iron ore mine in Peru will return to work on Wednesday after government labor authorities ordered the company to hike wages, a union leader said. The secretary general of the Shougang union, Richard Gaona, said workers would heed orders from labor authorities and return to work on Wednesday.

    The manager of the mine, Mr Raul Vera, confirmed the government had ordered wage increases and an end to the more than weeklong strike, which has disrupted shipments.

    Minmetals signs iron ore purchase agreement with Vale

    Reuters reported that state-owned metals and mineral trading firm China Minmetals signed a 20 million tonne iron ore purchase agreement with Brazilian mining giant Vale. The agreement was signed during a ceremony at the China International Import Expo in Shanghai. China is the world’s biggest consumer of the steelmaking ingredient.

    MinRes secured a milestone at Koolyanobbing iron ore operation in Western Australia

    Mineral Resources (MinRes) secured a milestone at the Koolyanobbing iron ore operation in Western Australia by delivering its first fully loaded train from the site to the Port of Esperance. The train departed from the Koolyanobbing site to Esperance yesterday for stockpiling in preparation for MinRes’ first shipment, which is expected to take place in the next four weeks. The train consisted of 106 wagons carrying 7488 tonnes of iron ore fines. Rail access was provided by Arc Infrastructure. MinRes announced it would acquire Koolyanobbing from previous owner Cleveland-Cliffs in June. The company completed the deal with the Western Australian Government two months ago. It expects to ship up to 6.25Mt/y of iron ore from the site, which is 50km north of Southern Cross.

    MinRes managing director Chris Ellison, said that “When we decided earlier this year to take on the Koolyanobbing operations previously operated by Cleveland-Cliffs, we did so because of our firm belief we could sustain a viable iron ore export operation in the region and safeguard hundreds of jobs in regional Western Australia. This successful outcome would not have been possible without the great assistance of Premier Mark McGowan and his Government, the leadership team at the Esperance port and Paul Larsen and his team at Arc Infrastructure.”

    Fortescue Metals to shore up trade relationships with China

    Sydney Morning Herald reported that WA iron ore giant Fortescue Metals Group will shore up trade relationships with China's biggest steel companies by signing eight memorandums of understanding with steel mills on the sidelines of the China International Import Expo. In a statement Fortescue announced it would sign MOUs with both public and private steel mills across the country, including China's largest steel group Baowu, which received the company's first cargo of ore 10 years ago. It will also sign an MOU with Hebei Iron and Steel Group, China’s second-largest steel company.

    While the MOUs don't have an immediate commercial impact, FMG chief executive Ms Elizabeth Gaines said it reaffirmed the company's commitment to its customers and demonstrated its presence in China. Ms Gaines reiterated the importance of Australia's trade relationship with China.

    Ms Gaines said that "As the One Belt, One Road initiative continues to grow, the openness and mutual understanding established by our bilateral trade relationships will be critical to its success. Australia’s significant strategic partnership with China is built on the importance of trade and is a fundamental pillar in our relationships across the Asian region."

    However, more than 3600 companies from 172 countries and regions are attending the expo, which opened in Shanghai on Tuesday and will run until November 10.

    Meer dan tweehonderd werknemers van staalbedrijf Thy Marcinelle in het Belgische Charleroi ontvingen vrijdag een aangename verrassing. Er werd meer dan 30.000 euro extra bij hun salaris gestort. Ze dachten dat het een vervroegd kerstcadeau was, zo meldt La Nouvelle Gazette.

    De man - die normaal een salaris krijgt van ongeveer 1.600 euro per maand - had maar liefst 31.464 euro ontvangen. Of 29.864 euro meer dan anders. ,,Maar het was duidelijk dat het om een vergissing ging, dus ik kwam er niet aan. Het teveel heb ik opzijgezet als voorzorgsmaatregel.”

    Boekhoudkundige fout
    Na deze boekhoudkundige fout werd een mail gestuurd naar de betrokken werknemers met de vraag om het bedrag terug te storten. In totaal zou zeven miljoen euro te veel zijn uitbetaald. ,,Het probleem is dat ik weet dat enkele collega's een deel van dat geld al hebben uitgegeven. Ze gingen naar het casino of er werden ‘automatisch’ schulden mee afbetaald doordat er beslag was gelegd op hun rekeningen. Ik was voorzichtig, ik raakte het geld niet aan, maar niet iedereen reageerde hetzelfde", zegt de werknemer die met de krant sprak.

    Of het bedrijf het geld terug zal zien, is niet duidelijk.

    SAIL RSP hot strip mill to be completed soon - Chairman

    PTI reported that SAIL Chairman Anil Kumar Chaudhary on Saturday said the new Hot Strip Mill at Rourkela Steel Plant should be completed by the beginning of next financial year, which will augment the unit’s hot rolled steel making capacity. He made the remarks while visiting the state-owned firm’s Rourkela Steel Plant. According to a statement, during his address, Chaudhary emphasized on early completion of the new 3.0 million tonnes per annum (MTPA) Hot Strip Mill (HSM). He said “The new HSM should be completed by the beginning of next financial year, which will augment the plant’s hot rolled steel making capacity along with enabling RSP to produce advance grade HR coils.”

    He added “This will help RSP to cater to the high end HR Steel segment and facilitate for supplying to Cold Rolling Mills producing auto grade steel, as per requirement.”

    During the visit, Chaudhary inaugurated the Additional Heat Treatment Line (AHTL) of the Special Plate Plant (SPP) of RSP. The Special Plate Plant has been catering to the needs of the nation’s defence and research programmes and has supplied steel for indigenous defence projects like INS Vikrant, INS Kamorta etc.

    Canada PM won’t attend USMCA signing - Report

    RCI Net reported that USMCA, the renewed and renamed pending trade agreement, between the United States, Mexico and Canada, signing is to take place on November 30th. But Canada’s Prime Minister Justin Trudeau will not attend the event if the steel and aluminum tariffs imposed on Canada are still in place, and will send another representative instead. Some high ranking Mexican officials have also expressed reservations about participating, in light of the same tariffs imposed on their steel and aluminium sector.

    Mr Ian Lee, an associate professor at the Sprott School of Business in Ottawa, said that for Justin Trudeau, entering into an election year in 2019, with these major trade issues brewing, it is a prudent move to skip the signing. He said He added that “I think now he doesn’t want to be seen as a cheerleader for it, and certainly going to a celebration while the tariffs are still on, still imposed on Canada, would be seen as celebrating and cheering an agreement that left the tariffs intact, and so that’s probably not good political optics and I think that that really explains why he has made that decision. It’s a lukewarm endorsement I have, it could have been much worse.”

    Mr Ian Lee said that in the new climate of negotiating with the Trump administration, this is not unexpected. He said that “There may be almost, in the negotiation over the words, almost a secondary set of negotiations because one has to be very careful that the wording used doesn’t twist the meaning of what was negotiated in the negotiating room”

    Former employee shoots dead manager at Tata Steel Processing and Distribution Faridabad

    A Senior Manager of Tata Steel subsidiary has been shot dead by a former company employee in Haryana’s Faridabad. Tata Steel said “At around 1:10 pm on Nov 9, 2018, an unfortunate incident took place at the Faridabad office of Tata Steel Processing and Distribution Ltd a Tata Steel subsidiary located inside the Tata Steel stockyard in Faridabad, wherein Mr Arindam Pal, Sr Manager (Supply Chain), was shot dead with a firearm by Mr Vishwash Pandey, an ex-employee of the company. Mr Pal expired on the way to the hospital. He is survived by his wife, parents and a daughter.”

    A former employee of the company was arrested in connection with the case on November 10. The police said the accused, identified as Vishwash Pandey, was planning to target three more employees of TSPDL. The court has remanded him in three-day police custody.

    Usha Martin secures shareholders’ approval to sell its steel unit to Tata Steel

    Business Line reported that Usha Martin Ltd has secured shareholders’ approval to sell its steel unit to Tata Steel for approximately INR 4,600 crore. Usha Martin had on Saturday sought shareholders approval though an extra ordinary general meeting. A stock market notification by the company said that over 99 per cent of the shareholders have voted in favour selling the steel unit to Tata Steel on a slump sale basis.

    According to Mr Rohit Nanda, CFO, Usha Martin, the deal is expected to be completed over the next few months. He told Business Line “Ideally, the sale should happen within the next two-four months. There are some approvals that are required from various government departments.”

    Tata Steel, through its subsidiary Tata Sponge, will be acquire the Jamshedpur-based unit. Along with the sale of the steel unit, there will also be a transfer of the iron ore mine situated at Ghatkuri block, coal mine under development situated in the Brinda and Sisai districts, and captive power plants, all located in Jharkhand.

    DMI&SP policy by Steel Ministry lands INR 8,129 crore orders with domestic steel makers

    Business Line reported that In what could be a big boost to ‘Make in India’ drive, government PSUs and railways have placed orders for iron and steel to the tune of INR 8,129 crore with domestic manufacturers during June 2017 to October 2018. It said with such placement of orders demand for domestic iron and steel products have witnessed a substantial growth. Ministry of Steel said in a statement that “Efforts made by the Ministry of Steel have ensured placement of orders for domestic iron and steel to the tune of INR 8,129 crore from June 2017 to October 2018. Ministry of Railways, ONGC, GAIL, EIL and HPCL have placed orders with domestic iron and steel manufactures for various categories of rails, pipe and tubes. These products were earlier imported but are now being procured from domestic producers.”

    The statement said that “Discussions are on with Ministry of Railways to increase consumption of rails manufactured indigenously either through SAIL or other domestic manufactures. Efforts are also being made to on-board sectors like Defence and CPWD so that use of steel products manufactured in India grows.”

    In order to give preference to domestically manufactured iron and steel products (DMI&SP) in government procurement, Ministry of Steel had promulgated a Policy, which was notified on May 8, 2017. According to the DMI&SP Policy, all government agencies are required to meet their requirements of steel products worth above INR 50 crore through locally manufactured steel. The policy covers Government PSUs, Societies, Trusts and statutory bodies set up by the Government. To ensure that the policy is implemented in letter and spirit, a Standing Committee under the Ministry of Steel chaired by steel secretary has been constituted to oversee its implementation.

    Indian Railways allowed to float global tender for steel rails

    Business Line reported that the Rail Vikas Nigam Ltd has been granted an exemption from the mandatory local sourcing clause while procuring steel rails. The exemption was given after it was found that Steel Authority of India Ltd cannot meet the full requirements of the company. The decision was taken at the eighth meeting of the Grievance Committee on Domestically Manufactured Iron and Steel Products (DMI&SP) Policy. With this the Railways can now float a 100 per cent global tender as Indian steel players have failed to meet quantity requirements of steel rails. According to the minutes of the meeting, Jindal Steel and Power Ltd, the only other local steel manufacturer that may fulfil the requirement, does not qualify either since it does not have a ‘passenger carrying certification’ from the Centre.

    RVNL said the estimated requirement of rails for projects to be commissioned in the next two years, including the short fall in the supply during the current financial year, is 500,000 tonne for the heavier section (60 kg) and high tensile strength (90 Ultimate Tensile Strength or wear resistant grade) rails. Rail PSU said in its submissions before the Committee that “RVNL is proceeding with invitation of global bidding for 500,000 tonne of 60 kg 90 UTS rails. Bids will be finalised after approval from the Ministry of Steel.”

    In its representation, RVNL said that “Considering the domestic production constraint of rails, which is very critical for passenger safety and non-availability of any other approved domestic manufacturer of rails other than SAIL, the Ministry of Railways has permitted RVNL to procure/ import rails from sources other than SAIL for rail requirement for projects to be commissioned in 2019-20 and 2020-21.”

    thyssenkrupp expects net income of EUR 0.1 billion

    thyssenkrupp Steel Europe AG, alongside other steel companies and associations, is the subject of ongoing investigations by the Federal Cartel Office into alleged cartel agreements relating to the product groups heavy plate and flat carbon steel. The pending investigations concern, in particular, allegations concerning collusion in the determination of surcharges and premiums for steel prices. thyssenkrupp takes this matter very seriously and, with external support, has conducted its own internal investigation of the matter. It said “Based on the facts currently known to us, we cannot exclude substantial adverse consequences with regard to the Group’s asset, financial and earnings situation. Due to new developments in the investigation process, thyssenkrupp has decided to accrue risk provisions in the consolidated financial statements. This will result in a net income for the year below the previous year's level (net income for the 2017/2018 financial year is expected to be EUR 0.1 billion, compared with EUR 271 million in the previous year).”

    IPSCO Tubulars Inc announced the opening of its new ULTRA™ FBE Coating Facility in Wilder, KY. The coating facility is strategically situated near the rich natural gas deposits of the Marcellus Shale formation. The plant externally coats flowline, gathering and transmission lines up to 24 inches in diameter and has excellent logistics to ship the finished pipes by truck, rail or barge.

    The 280,000 tons of annual coating capacity is available in Fusion Bond Epoxy, Abrasion Resistant Overcoat and Speciality Coating. The plant is certified to industry standards, including CSA Z245.20, NACE SP0394, and AWWA C213, as well as end users’ specific standards. Extensive quality and material inspection equipment will be utilized.

    Mr Piotr Galitzine chairman and CEO said that “Coating is utilized by operators to provide protection against corrosion, mechanical damage, and weathering. With ready access to ULTRA coating services, our customers can avail themselves of the best technology in the sector.”

    Congress promises return of land acquired for Tata Steel project in Bastar

    ToI reported that Congress president Rahul Gandhi on Saturday mounted a blistering attack on BJP governments at the centre and state over land acquisition in Chhattisgarh and promised to return the land acquired from tribals in 2005 for the proposed Tata Steel’s integrated steel plant project, which has now been abandoned. Addressing an election meeting at Jagdalpur, the divisional headquarters of Bastar, he said “After formation of our government in Chhattisgarh, we will return about 4000 acres of land acquired for Tata Steel project to original owners.”

    Asserting that the Congress government would give tribals their right on land under the Panchayat Extension in Scheduled Areas (PESA) Act, Rahul said its Congress party’s resolve that farmers' land would not be acquired without their consent and if the farmers are ready to part with their land for any project they would be entitled for compensation which would be four times more than the prevailing market rates.

    The BJP government had signed an Moll with Tata Steel in 2005 to set up the mega steel plant. A total of 2044 hectares of land from 10 villages had been acquired despite protests from the locals.

    BHP to meet iron ore commitments despite train derailment in Western Australia - CEO

    Reuters cited Mr Andrew Mackenzie CEO of global miner BHP Billiton as saying that BHP will meet its iron ore commitments to customers despite a supply disruption after it had to derail a runaway ore train in Western Australia. The miner suspended its rail operations after the incident on last Monday that wrecked track and left a locomotive and wagons upturned nearly 120 km south of Australia’s iron ore export hub of Port Hedland. Asked whether BHP would invoke force majeure, Mr Mackenzie told media after the company’s annual general meeting in South Australia that he did not expect the miner would let down any of its customers. He said that “We will have the ability to supply our customers as we have been contracted to do.”

    BHP said that it would use stockpiles at Port Hedland to maintain its port operations, but that the reserves were not expected to cover the entire period of disruption.

    Mr Mackenzie said that “We have got about 130 people working night and day to get this fixed. We are continuing to mine so we will have good stocks at the mines as soon as the rail fully opens and we believe that with the recovery plan that we have, which is within a week, we will not be letting down any of our customers.”
